§40.45 What materials are used to send urine specimens to the laboratory?

(a) Except as provided in paragraph (b) of this section, you must use a shipping container [(Part 40 Definition) A container that is used for transporting and protecting specimen bottles and associated documents from the collection site to the laboratory.] that adequately protects the specimen [(Part 40 Definition) Fluid, breath, or other material collected from an employee at the collection site for the purpose of a drug or alcohol test.] bottles from shipment damage in the transport of specimens from the collection site [(Part 40 Definition) A place selected by the employer where employees present themselves for the purpose of providing a specimen for a drug test.] to the laboratory [(Part 40 Definition) Any U.S. laboratory certified by HHS under the National Laboratory Certification Program as meeting the minimum standards set by HHS; or, in the case of foreign laboratories, a laboratory approved for participation by DOT under this part.].

(b) You are not required to use a shipping container if a laboratory courier hand-delivers the specimens from the collection site to the laboratory.
